HC relief for Priyanka on house details

Shimla,08/july/2015 (ITNN)>>>> The Himachal Pradesh High Court on Tuesday stayed the State Information Commission’s order asking Priyanka Vadra,daughter of Congress president Sonia Gandhi, to reveal information on her house under construction here to a Right to Information activist in 10 days. Ms.Vadra had challenged the order in the High Court last week.

The court said the petitioner had made a prima facie case for interim relief. Quoting an English common law maxim, “Every man’s house is his castle,the court said: There could be nothing more deleterious to a person’s physical happiness, health and safety than a calculated interference with his privacy.

Two purchases

Ms.Vadra had made two real estate purchases at Chharabra, a suburb near Retreat,the summer residence of the President. She has been constructing a house here for a few years on which the activist Dev Ashish Bhattacharya sought information. The local people have not been allowed any private or commercial activity here for security reasons. But Ms. Vadra was given permission to construct the house by the Congress and the BJP governments as she was under SPG protection.

On the ground of security, the Shimla district administration had avoided sharing information under the RTI Act about the construction. The two-member Bench of the Information Commission, in its ruling, maintained that the information had been wrongly withheld. The Bench asked the first appellate authority as to why it should not be penalised for withholding information.

Records sought

The records sought by the activist include those on the registration-cum-sale deed, the status of the land and the permission granted under Section 118 of the Himachal Tenancy and Land Reforms Act.
